BetterWake is a wellness product, not a medical device. It estimates sleep from heart rate and motion, and doesn't diagnose or treat any condition. For sleep concerns, talk to your doctor.
By using BetterWake you agree to these terms and to Apple's standard Licensed Application End User License Agreement. If you don't agree, please don't use the app. In these terms, "we" and "us" mean the developer of BetterWake, the seller named on its App Store page.
BetterWake estimates sleep stages from your heart rate and motion. These estimates are for general wellness and better mornings only. BetterWake is not a medical device and does not diagnose, treat, cure, prevent, or monitor any disease or medical condition, including sleep disorders such as insomnia or sleep apnea. Sleep-stage estimates from any wrist-worn device are imperfect by nature, and BetterWake makes no accuracy guarantees. Nothing in the app is medical advice — if you have concerns about your sleep or health, talk to a doctor.
BetterWake is built so the alarm rings at your set deadline even when sleep tracking fails. Still, no app can overcome every situation: a dead battery, muted volume, Do Not Disturb misconfiguration, a force-quit app, or a system failure can silence any alarm, including this one. For events you absolutely cannot miss — flights, exams — set a backup alarm. You remain responsible for waking up on time.
BetterWake offers auto-renewing subscriptions (monthly and annual), billed by Apple through your Apple ID. If a free trial is offered, its length is shown before you start; when the trial ends, the subscription you selected begins automatically unless you cancel at least 24 hours before the trial ends. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel anytime in your Apple ID settings. Prices may change for future periods; Apple will notify you and ask for consent where required. Billing and refunds are handled by Apple — you can request a refund at reportaproblem.apple.com.
BetterWake comes with its own alarm tones and sleep sounds. You can also import your own audio, videos, and pictures to personalize alarms (from videos, only the audio is kept). Those are stored only on your device and used only to play and display your alarms. You are responsible for having the rights to any files you import. BetterWake does not sell or download music.
BetterWake™ is a trademark of Jonathan Ferster. The app, its design, and its algorithms are licensed to you for personal use on your Apple devices — not sold. Please don't copy, resell, or reverse engineer the app.
BetterWake is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.
To the maximum extent permitted by law, our total liability for any claim arising from BetterWake is limited to the amount you paid for it in the 12 months before the claim, and we are not liable for indirect or consequential damages — including damages from oversleeping or missed events. Some jurisdictions don't allow certain limits; in those places these limits apply to the fullest extent permitted.
You need to be at least 13 years old to use BetterWake, and old enough where you live to agree to terms like these. If you're under 18, please go through a parent or guardian. BetterWake is not designed for children.
You can end this agreement at any time by deleting the app; cancelling a subscription is handled through your Apple ID settings. We may suspend access if the app is being used unlawfully or in a way that harms the service. If this agreement ends, the sections that should outlive it — the wellness-product disclaimer, no warranty, and limitation of liability — continue to apply.
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. If we have a dispute that talking to us cannot settle, it will be heard in the state or federal courts located in Miami-Dade County, Florida, and you agree to those courts. If you live somewhere whose consumer-protection laws give you rights these terms cannot take away, those rights still apply.
If these terms change, the new version will appear here and in the app with an updated date. Continuing to use BetterWake after a change means you accept the new terms.
